Deuteronomy 25

KING JAMES BIBLE

1If there be a controversy between men, and they come unto judgment, that the judges may judge them; then they shall justify the righteous, and condemn the wicked.

2And it shall be, if the wicked man be worthy to be beaten, that the judge shall cause him to lie down, and to be beaten before his face, according to his fault, by a certain number.

3Forty stripes he may give him, and not exceed: lest, if he should exceed, and beat him above these with many stripes, then thy brother should seem vile unto thee.

4Thou shalt not muzzle the ox when he treadeth out the corn.

5If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not marry without unto a stranger: her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of an husband's brother unto her.

6And it shall be, that the firstborn which she beareth shall succeed in the name of his brother which is dead, that his name be not put out of Israel.

7And if the man like not to take his brother's wife, then let his brother's wife go up to the gate unto the elders, and say, My husband's brother refuseth to raise up unto his brother a name in Israel, he will not perform the duty of my husband's brother.

8Then the elders of his city shall call him, and speak unto him: and ifhe stand to it, and say, I like not to take her;

9Then shall his brother's wife come unto him in the presence of the elders, and loose his shoe from off his foot, and spit in his face, and shall answer and say, So shall it be done unto that man that will not build up his brother's house.

10And his name shall be called in Israel, The house of him that hath his shoe loosed.

11When men strive together one with another, and the wife of the one draweth near for to deliver her husband out of the hand of him that smiteth him, and putteth forth her hand, and taketh him by the secrets:

12Then thou shalt cut off her hand, thine eye shall not pity her.

13Thou shalt not have in thy bag divers weights, a great and a small.

14Thou shalt not have in thine house divers measures, a great and a small.

15But thou shalt have a perfect and just weight, a perfect and just measure shalt thou have: that thy days may be lengthened in the land which the LORD thy God giveth thee.

16For all that do such things, and all that do unrighteously, are an abomination unto the LORD thy God.

17Remember what Amalek did unto thee by the way, when ye were come forth out of Egypt;

18How he met thee by the way, and smote the hindmost of thee, evenall that were feeble behind thee, when thou wast faint and weary; and he feared not God.

19Therefore it shall be, when the LORD thy God hath given thee rest from all thine enemies round about, in the land which the LORD thy God giveth thee for an inheritance to possess it, that thou shalt blot out the remembrance of Amalek from under heaven; thou shalt not forget it.

6 And it shall be, that the first borne which she beareth, shall succeede in the name of his brother which is dead, that his name be not put out of Israel.

7 And if the man like not to take his brothers wife, then let his brothers wife go vp to the gate, vnto the Elders, and say, My husbands brother refuseth to raise vp vnto his brother a name in Israel: he will not performe the dutie of my husbands brother.

8 Then the Elders of his citie shall call him and speake vnto him: and if he stand to it, and say, I like not to take her:

17 Remember what Amalek did vnto thee by the way, when ye were come foorth out of Egypt:

18 How he met thee by the way, and smote the hindmost of thee, euen all that were feeble behinde thee, when thou wast faint and weary; and he feared not God.

19 Therefore it shall bee when the Lord thy God hath giuen thee rest from all thine enemies round about, in the land which the Lord thy God giueth thee for an inheritance to possesse it; that thou shalt blot out the remembrance of Amalek from vnder heauen: thou shalt not forget it.

THE NEW AMERICAN BIBLE

1 "When men have a dispute and bring it to court, and a decision is handed down to them acquitting the innocent party and condemning the guilty party,

2 if the latter deserves stripes, the judge shall have him lie down and in his presence receive the number of stripes his guilt deserves.

3 Forty stripes may be given him, but no more; lest, if he were beaten with more stripes than these, your kinsman should be looked upon as disgraced because of the severity of the beating.

4 "You shall not muzzle an ox when it is treading out grain.

5 "When brothers live together and one of them dies without a son, the widow of the deceased shall not marry anyone outside the family; but her husband's brother shall go to her and perform the duty of a brother-in-law by marrying her.

6 The first-born son she bears shall continue the line of the deceased brother, that his name may not be blotted out from Israel.

7 If, however, a man does not care to marry his brother's wife, she shall go up to the elders at the gate and declare, 'My brother-in-law does not intend to perform his duty toward me and refuses to perpetuate his brother's name in Israel.'

8 Thereupon the elders of his city shall summon him and admonish him. If he persists in saying, 'I am not willing to marry her,'

9 his sister-in-law, in the presence of the elders, shall go up to him and strip his sandal from his foot and spit in his face, saying publicly, 'This is how one should be treated who will not build up his brother's family!'

10 And his lineage shall be spoken of in Israel as 'the family of the man stripped of his sandal.'

11 "When two men are fighting and the wife of one intervenes to save her husband from the blows of his opponent, if she stretches out her hand and seizes the latter by his private parts,

12 you shall chop off her hand without pity.

13 "You shall not keep two differing weights in your bag, one large and the other small;

14 nor shall you keep two different measures in your house, one large and the other small.

15 But use a true and just weight, and a true and just measure, that you may have a long life on the land which the LORD, your God, is giving you.

16 Everyone who is dishonest in any of these matters is an abomination to the LORD, your God.

17 "Bear in mind what Amalek did to you on the journey after you left Egypt,

18 how without fear of any god he harassed you along the way, weak and weary as you were, and cut off at the rear all those who lagged behind.

19 Therefore, when the LORD, your God, gives you rest from all your enemies round about in the land which he is giving you to occupy as your heritage, you shall blot out the memory of Amalek from under the heavens. Do not forget!

COMMENTARIE

v 1-3. The Jews practiced 40 stripes save 1, that is 39, so they would not make a mistake and go above 40, thus disobeying this rule, 2 Cor. 11:24.

v 5-10. If a Jewish man died without sons, his brother was to marry the woman and the firstborn son would carry on the inheritance of the first husband. Some refused to do this, such as Onan in Gen. 38:9. However it was a shame to disobey. This was only partially involved in Ruth 4:7, so she did not spit in the man’s face.

v 11,12. I know two men who were fighting on the street in my town, and the wife of one started hitting the other with her shoe. Had she done as this woman did , she would have lost her hand.

v 13-16. This involves honest weights and measures.

v 17-19. The Lord’s statement, Ex. 17:16, that He would have war with Amalek from generation to generation proved quite true, as Amalek is mentioned numerous times in six other books of the Bible. This was after the incident where Aaron and Hur held up Moses hands while they fought Amalek. Israel was told in Deut. 25:19 to blot out the name of Amalek, but they failed to do so. Saul was told to utterly destroy Amalek, 1 Sam. 15:3, but he also failed to do so.
